Cohen had accused Burton in court papers — Cohen called it a lawsuit and opposing lawyers called it a petition — of conspiring with Detroit probate lawyers John Chase Jr. and Melvin Jefferson Jr. by allowing them to gouge the estate with excessive and unnecessary legal fees. Cohen said Burton improperly dismissed the lawsuit and then rejected Cohen’s disqualification motion.

National Association to Stop Guardian Abuse: Chief of Wayne County Probate Court Refuses to Take Judge Off Rosa Parks Case

The chief judge of Wayne County Probate Court refused Friday to remove one of his colleagues from presiding over the estate of Rosa Parks, the late civil rights icon. Judge Milton Mack Jr. said attorney Steven Cohen of Farmington Hills failed to present any evidence to justify removing Judge Freddie Burton Jr. from the estate, which has been embroiled in controversy since Parks died in 2005. “There has been no showing of personal bias,” Mack said after a 30-minute hearing, adding that Cohen’s decision to sue Burton and then demand his removal from the case amounted to “naked forum shopping.” Cohen has accused Burton of allowing Detroit probate lawyers John Chase Jr. and Melvin Jefferson Jr. to drain the estate with excessive and unnecessary legal fees. Cohen said Burton improperly dismissed his suit and then rejected Cohen’s motion to disqualify himself. Cohen represents Elaine Steele, Parks’ longtime personal assistant, and the Rosa and Raymond Parks Institute for Self-Development, which the two women formed in the 1980s. Attorney Steven Cohen Faces Possible Contempt Charges in Wayne County Probate Court

Probate Judge Terrance Keith late last week denied Cohen’s petition to set aside an amended version of Barden’s trust drafted in 2010.He also granted separate requests for summary disposition by Chase and the late Bella Marshall Barden’s estate, granted a request for sanctions against Cohen and scheduled a show cause hearing for July 27 as to why Cohen shouldn’t be found in criminal contempt of court for the media disclosures.

A Gay Crows Nest: Well prepared to exercise democracy

My friend and debate partner, because of his age, doesn’t need to give a reason to get an absentee ballot in Michigan. I’m not there yet, so will go to my local polling place. My friend now has his ballot and was a bit surprised at the length. Both he and I knew about the state proposals (there are six this year), but didn’t know about the five Wayne County proposals. He is glad he has time to research them (and send me what he found). That reminds me I should mention the site Publius. Give it your name and city and it searches the voting rolls so that it can show you a sample ballot. In each race it also shows a link to the candidate’s website and party site, and (at least in Michigan) a link to the Secretary of State record of the candidate’s campaign committee. On my sample ballot: President, US Senator, US Rep, state Rep, state Board of Ed. and several university trustees, various county officials, judges for state Supreme Court, Circuit Court, Court of Appeals (who are these people?), and Probate Court, state proposals, and county proposals. I suspect it isn’t complete because I see signs for school board elections and those candidates aren’t listed. Advice from my friend: when going to the polling place, take lunch.

Incarcerating Persons with Mental Illness

The good news is that there are solutions. In 2009, the legislature appropriated $1.75 million for pilot programs in nine local mental health courts. According to the Michigan Police Network mental health courts operate in Wayne, Kalamazoo, and Ionia/Montcalm Counties. A 2010 Michigan Supreme Court evaluation concluded that nearly all participating counties reported positive mental health outcomes and increased education and employment. Genesee County has implemented a juvenile mental health court with positive results for those who complete the program.
